IMPORTANT: These Terms contain a binding arbitration agreement and a class action waiver that affect your legal rights. Please read Section 19 carefully.

1. Acceptance of Terms

By accessing, browsing, or using any service provided by ALTR ("Company," "ALTR," "we," "us," or "our") — including our website, mobile experience, vehicle access programs, and related services (collectively, the "Services") — you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms").

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE OUR SERVICES.

Age Eligibility
  • 21 years or older is required to participate in ALTR's direct vehicle access programs (ALTR Drive, ALTR Direct, Fleet, and Host).
  • 18 years or older is permitted only for users booking ALTR-listed vehicles through the Turo platform, subject to Turo's own age and eligibility requirements.

By using our Services, you also represent and warrant that you are:

  • Legally capable of entering into binding contracts
  • A resident of the United States
  • Not prohibited from using our Services under applicable law

2. Company Information

These Terms are entered into between you and:

ALTR is a mobility and fleet operations company that provides vehicle access programs to qualified drivers and lists vehicles on third-party marketplaces such as Turo. ALTR is not an insurer, broker-dealer, or transportation network company.

3. Description of Services

Our Services include, but are not limited to:

  • ALTR Drive: Weekly vehicle access for rideshare, delivery, and approved personal use.
  • ALTR Direct: Direct-to-consumer short- and mid-term vehicle access.
  • Turo Listings: ALTR-owned vehicles listed for booking through Turo.
  • Fleet: Multi-vehicle programs for business operators.
  • Host Program: Vehicle owners placing cars under ALTR management.
  • Driver Application Platform: Online applications, document uploads, and account management.

Vehicle availability, pricing, and program features may change without notice. Use of any specific vehicle is not guaranteed.

4. Driver Eligibility & Licensing

  • Valid, unexpired U.S. driver's license held for the minimum required term
  • Minimum age 21 for ALTR direct programs; 18 permitted only via Turo bookings
  • Pass an approved Motor Vehicle Record (MVR) and background check
  • Maintain personal auto insurance meeting Florida minimums (see Section 6)
  • If driving for rideshare or delivery, maintain active approved status on each applicable platform (Uber, Lyft, DoorDash, Uber Eats, Instacart, etc.)
  • No disqualifying violations, suspensions, or revocations within the lookback period

ALTR may refuse, suspend, or terminate access at its sole discretion if eligibility criteria are not met or maintained.

5. Vehicle Use & Care

Permitted use:

  • Rideshare and delivery work on approved platforms
  • Personal transportation by the assigned driver
  • Operation within the continental United States unless otherwise authorized

Prohibited use includes, without limitation:

  • Racing, speed contests, off-road driving, or stunt driving
  • Transporting illegal cargo, hazardous materials, or unlawful passengers
  • Sub-renting, lending, or transferring the vehicle to any unauthorized person
  • Towing, pushing, or hauling beyond manufacturer specifications
  • Operation by anyone not approved on the account
  • Smoking, vaping, or transporting unsecured pets without authorization
  • Use while impaired by alcohol, drugs, or any controlled substance

Drivers are responsible for routine care including fuel/charging, tire pressure, fluid checks, cleanliness, and prompt reporting of mechanical issues.

6. Insurance & Liability

Drivers must carry and maintain valid personal auto insurance meeting or exceeding Florida state minimums for the duration of their access. Coverage must be in the driver's name and remain in force at all times.

  • Disclose all rideshare or delivery (gig/business) use to your carrier
  • Provide proof of insurance on demand
  • Notify ALTR within 24 hours of any lapse, cancellation, or material change
  • Acknowledge that personal policies may exclude commercial use; you are responsible for any coverage gap

ALTR's insurance, if any, is secondary and may be subject to deductibles, exclusions, and program-specific limits. ALTR is not an insurer and does not provide primary coverage to drivers.

7. Accidents, Damage & Claims

Mandatory Reporting

Any accident, collision, theft, vandalism, or significant damage must be reported immediately using the ALTR Accident Claim Form at /report-accident. Failure to report promptly may result in personal financial liability and termination of access.

  • Call 911 if there are injuries or significant property damage
  • Obtain a police report and provide officer name, badge, and case number
  • Capture photos of all vehicles, damage, license plates, insurance cards, and the scene
  • Collect other-party contact, insurance, and license information
  • Do not admit fault or negotiate settlement on ALTR's behalf
  • Authorize towing only by an ALTR-approved provider when possible

Drivers may be responsible for deductibles, loss-of-use fees, diminished value, repair costs, and administrative fees as outlined in their access agreement.

8. Payments, Fees & Deposits

  • Weekly access fees are charged in advance via the payment method on file
  • Late payments incur late fees and may trigger immediate suspension
  • Refundable security deposit may be required and held against damage or unpaid balances
  • Fuel, charging, cleaning, and detail surcharges apply to vehicles returned outside policy
  • Tolls, citations, parking tickets, and red-light camera fees pass through with an administrative fee
  • Damage charges are assessed based on inspection and may include third-party repair invoices

You authorize ALTR to charge your payment method for all amounts owed, including post-return adjustments. Disputed charges must be raised in writing within 30 days.

9. Cancellation & Termination

Either party may end the relationship in accordance with the applicable program agreement. ALTR may terminate access immediately and without refund for cause, including but not limited to:

  • Insurance lapse or fraudulent insurance documentation
  • Concealing or misrepresenting an accident or damage
  • Prohibited use or unauthorized drivers
  • Non-payment or chargebacks
  • Tampering with telematics, GPS, or vehicle systems
  • Threatening or abusive conduct toward ALTR staff or partners

Upon termination, the vehicle must be returned in the agreed condition. ALTR reserves the right to repossess the vehicle and recover related costs.

10. TCPA Consent & Communications

Express Written Consent
By providing your phone number and submitting any form on our website, you provide your express written consent to receive communications from ALTR, our affiliates, and service providers at the number(s) you provided.

You expressly consent to receive:

  • Telephone calls, including calls placed via automatic telephone dialing systems (ATDS)
  • Pre-recorded or artificial voice messages
  • SMS and MMS text messages
  • Email communications

Purposes may include: application status, vehicle availability, payment reminders, safety alerts, recall notices, marketing, and service updates.

No purchase required: Consent is not a condition of any service.

Do Not Call override: You agree to receive calls and texts even if your number is on a state or federal Do Not Call list.

11. SMS / Text Messaging Terms

Text Message Disclosure
  • Message Frequency: Varies based on activity and inquiries
  • Message & Data Rates: Standard rates may apply per your carrier plan
  • Carriers: Carriers are not liable for delayed or undelivered messages

How to opt out:

Compatible with major U.S. carriers including AT&T, Verizon, T-Mobile, and most regional carriers.

12. Background Checks & MVR

In compliance with the Fair Credit Reporting Act (FCRA), you authorize ALTR and its vendors to obtain consumer reports and motor vehicle records for eligibility, ongoing monitoring, and program compliance. You may request a copy of any report that influenced an adverse action.

13. Host Program Terms

  • Hosts are independent contractors, not employees, agents, or partners of ALTR
  • Vehicles must meet ALTR's eligibility, year, mileage, and condition standards
  • Hosts must maintain clean title, valid registration, and required insurance
  • Payouts are calculated per the host agreement and are subject to deductions for damage, claims, and fees
  • ALTR may delist any vehicle that fails inspection, safety, or performance criteria

14. Turo Bookings

Third-Party Marketplace
ALTR-listed vehicles booked through Turo are governed by Turo's Terms of Service in addition to these Terms. The Turo platform's minimum age of 18 applies only through Turo; ALTR's direct programs require 21+.

In the event of a conflict between Turo's terms and these Terms with respect to a Turo booking, Turo's marketplace rules govern the booking transaction. ALTR's vehicle care, accident reporting, and prohibited-use rules continue to apply to all ALTR-owned vehicles.

15. Prohibited Activities

  • Submitting false, fraudulent, or misleading information in any application or claim
  • Sharing account credentials or letting unapproved drivers operate the vehicle
  • Tampering with, removing, or disabling telematics, GPS, dash cameras, or other vehicle systems
  • Reverse engineering, scraping, or interfering with the ALTR platform
  • Using ALTR vehicles to commit any crime or violate any law
  • Harassing, threatening, or abusing ALTR staff, partners, or other users

16. Intellectual Property

The ALTR and KAAROS names, logos, marks, software, designs, and content are owned by their respective holders and protected by U.S. and international intellectual property laws. No license or right is granted to use any mark or content except as expressly permitted in writing.

17. Disclaimers & Limitation of Liability

Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

To the maximum extent permitted by law, ALTR disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. ALTR does not warrant uninterrupted vehicle availability or error-free operation of the platform.

In no event shall ALTR's aggregate liability exceed the greater of (a) the amounts paid by you to ALTR in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100). ALTR is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost earnings from rideshare or delivery work.

18. Indemnification

You agree to indemnify, defend, and hold harmless ALTR, its affiliates, officers, directors, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Services or any vehicle; (b) your violation of these Terms or any law; (c) your violation of any third-party right; and (d) any content or information you submit.

19. Arbitration Agreement & Class Action Waiver

Binding Arbitration
You and ALTR agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by JAMS under its then-current rules, in Florida, rather than in court.
  • Class action waiver: Disputes must be brought individually, not as part of a class, collective, or representative action
  • Jury trial waiver: Both parties waive any right to a jury trial
  • Opt-out: You may opt out of this arbitration agreement by emailing legal@drivealtr.com within 30 days of first accepting these Terms
  • Exceptions: Either party may bring qualifying claims in small-claims court or seek injunctive relief for IP infringement

20. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the arbitration clause above, the exclusive jurisdiction and venue for any action shall be the state and federal courts located in Florida, and you consent to personal jurisdiction in such courts.

21. Modifications to Terms

ALTR may modify these Terms at any time. Material changes will be communicated via email or in-app notice. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.
